Terms and Conditions (“Terms”)

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Videoblast Date mobile application (the “Service”) operated by REAPPS LLC (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of REAPPS L.L.C., Videoblast and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of REAPPS L.L.C.

Any content provided in the app is re-created, created by us, any content that we may own we license. You may use the content delivered by us to you for personal or commercial purposes without any prior permission. You may not copy or replicate the functionality of Videoblast or any of it’s special software that makes the service possible.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by REAPPS L.L.C.

REAPPS LLC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that REAPPS LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease.

We may at anytime also stop delivering the service or may terminate requests you have made within the service, without prior notice or liability for any reason whatsoever, including without limitation if you breach the Terms.

Templates with hatred messages, or any message that may promote violence, hatred, terrorism, contain profanity or that touch upon a sensitive subject, we may and can outright terminate your request or your account, and if purchased you may not be eligible for a refund. This also includes overly negative religious messages that may induce any form of negativity.

If you try to abuse the ordering and rendering request we may cease to deliver the service to you or ban your account without any prior warning or notice. Any fraudulent attempts to cheat the ordering process will cause the render to be terminated.

Jailborken devices can use the app but accounts will be flagged and renders will not go through. We also reserve the right to ask and request any reasonable information that may help us identify your purchase in case your account is locked or terminated.

Video Retention Disclaimer

Note that Videoblast holds the right to delete any videos at anytime from our servers and local backups. You can access videos from Videoblast at anytime that you wish, however it is a best practice to save your videos to your device after they have been rendered.

Free renders may be deleted one week after render, permanently from our servers and local backups. While we try to keep paid templates at hand on backup for users who may lose them and we also keep them in our servers for as long as necessary and for as long as it does not cause us any liability.

Limitation Of Liability

In no event shall REAPPS L.L.C., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

REAPPS L.L.C. its subsidiaries, affiliates, and its licencors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Depending on the requests or the time you send the request in, the videos do take some time to be rendered and delivered. This may take anywhere from 1 hour or less to a couple of days in cases where there is an issue.

The service can pause at anytime for any reason but mostly for maintenance of the cloud servers, creating new content or just a surge in requests. To deliver the best service at the quickest time we may pause new requests, this will be indicated at the Store page and at the Request page. You may purchase any of the Store products, but do note that you will not be able to place your request, unless the service is available. Most times the service will resume in a short period of time.

We are not responsible for correcting any misspellings that you may have on your text when you’re submitting a request, you may contact us if you notice that you have a misspelling or want to change the request text/logo. Depending on the time and number of requests we may or may not be able to accommodate your request.

We try to cover a broad range of characters special characters or certain characters from certain languages may be incompatible with the some or all templates, in this case we hold the right to cancel the request while providing back the used credits.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Data We Collect

REAPPS LLC reserves the right to use and disclose the collected, non-personal data for purposes of advertising by Videoblast or REAPPS’s partners and contractors. However Videoblast collects the most minimal data possible, we are in the business of serving the greatest content that we can and are not in the business of collecting your data. Hence we gather only the most minimal information that is needed in order to enable us to deliver the best experience we can for you.

Videoblast may store email address in order to enable you to get authenticated via the app and to deliver your personal content to your account. The text that you add to your intros is only used in order so that your content may be rendered and is not used for anything else. We store your rendered videos in our servers in order to deliver them to you and in order to store them for you so that you may access them in the future. You may at anytime choose to delete your Videoblast account by going through the App Account Settings and tapping “Delete Account”.

Videoblast may employ third party ad serving technologies that use certain methods to collect information as a result of ad serving through Services.

Third parties operating the ad serving technology may use demographic and geo-location information (for more information regarding use of Location Data see below Section 3) as well as information logged from your hardware or device to ensure that relevant advertising is presented within the Service. Third parties may collect and use data, for such purposes, including but not limited to, data such as IP address, Device ID, MAC address, installed software, application usage data, hardware type, Operating System information, browser information, unique identifiers in browser cookies, Flash cookies, and HTML5 local storage, Internet and on-line usage information.

We may also use your email address to contact you regarding new offerings and intros in the app that you may be interested at or about critical releases.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
